Compliance Requirements for Municipal & Public Works

Confined Spaces 29 CFR 1910.146

Sewer access points, manholes, vaults, and lift station wet wells are permit-required confined spaces. Employers must maintain a written program, train entry teams, and document rescue procedures. Confined space violations carry some of the highest average penalty amounts.

Excavation and Trenching 29 CFR 1926 Subpart P

Public works crews installing or repairing underground infrastructure must follow cave-in protection requirements for all trenches deeper than 5 feet. Trenching is one of OSHA's "Fatal Four" causes of construction worker deaths.

Electrical Safety 29 CFR 1910.331-335

Crews working on streetlights, traffic signals, and electrical infrastructure must be trained on shock and arc flash hazards, approach boundaries, and PPE requirements. Electrical safety violations frequently appear in OSHA's most-cited list.

Lockout/Tagout 29 CFR 1910.147

Required for all equipment servicing in fleet maintenance shops, pump houses, and equipment yards. The Control of Hazardous Energy standard ranks consistently in OSHA's top 5 most-cited violations.

Hazard Communication 29 CFR 1910.1200

Vehicle fluids, fuels, solvents, paints, herbicides, and de-icers all require safety data sheets, written programs, and employee training. HAZCOM ranked #2 on OSHA's FY 2024 most-cited list.

Personal Protective Equipment 29 CFR 1910.132

Employers must conduct hazard assessments, provide appropriate PPE, and train employees on proper use. Public works crews need traffic-grade high-visibility vests, hard hats, hearing protection, and task-specific PPE for chemical and electrical work.

Fleet Driver Safety General Duty Clause / 49 CFR 390-397

Operators of municipal vehicles, dump trucks, sweepers, sanitation equipment, and aerial lifts need defensive driving and equipment-specific training. Fleet accidents are a major liability and workers' comp exposure.

Aerial Lifts and MEWPs 29 CFR 1926.453 / ANSI A92

Bucket trucks, scissor lifts, and boom lifts require operator training and pre-use inspections. Aerial lift training is mandatory before any worker operates a Mobile Elevating Work Platform.

State OSHA plan states may have additional requirements beyond federal OSHA. Penalties for serious violations can reach $16,550 per instance. Repeat or willful violations carry penalties up to $165,514.
